There are a number of false light cases indicating that even editorial photographs taken in public can be actionable. E.g. publishing a photo of someone walking in front of an adult book store or rehab clinic can give a false impression, even if they were publicly observable in front of those places. There may be other exceptions as well (not that they apply here).

He should have been ruled as "possessing" the ball as soon as he turned upfield and took two steps. Anything that happened after he touched out of bounds is (or should have been) irrelevant.
