I'm not sure it works like that. Once collusion is shown, loss of any one contract is going to constitute a full loss of salary to Kaep. If you are fired from your job due to illegal discrimination, would the company be able to claim that the damages were negligible because you could have gotten thousands of other jobs?

I think Kaep would have an ordinary duty to try to mitigate - i.e. to keep looking for comparable work - but any team who decided not to hire him would be the "but for" cause keeping him from a $X million contract. Kaep would also be entitled to treble damages if he won.

1. Not so much impossible to enforce, but difficult to prove. You would need to find some tangible evidence of an agreement (e.g. audio recordings of phone conversations, or emails showing where it was discussed). You couldn't win just by showing that owners disliked him, or showing that he's a better QB than Kirk Cousins or Blake Bortles. You need a smoking gun like a text message between two owners saying "Let's make sure this guy never works in the league again."

So that makes it tough to prove, but it does means that the plaintiff gets a wide berth for discovery - all of the team owners and executives' emails, text messages, records of phone calls for the relevant period, deposing NFL team owners one by one - you start to see why the NFL would be inclined to settle even if they don't think Kaep would be able prove collusion.

Kaep was filing a grievance under Article 17 of the CBA, which reads, in relevant part:

"No Club shall enter into any agreement... with any other Club...to restrict or limit individual Club decision-making (including):

  1. whether to negotiate or not to negotiate with any player;
  2. whether to offer or not to offer a Player Contract to any player"

Kaep only needs to show that any two or more teams colluded not to hire him, not all 32 teams, and doesn't have to prove the existence of a cartel.

Sport Illustrated published something a while breaking down what Kaepernick needed to prove to make his case: 

"7. Kaepernick turning down free-agent offers wouldn’t disprove collusion

Some have speculated that Kaepernick might have told teams, or at least implied to them, that he wants to start. It’s also possible that Kaepernick has turned down overtures—perhaps even offers—from teams that want to sign him.

None of that would prevent Kaepernick from proving collusion. Why? Because an alleged conspiracy might have involved other teams and their officials. If two teams colluded against Kaepernick, and the 30 other teams did not collude, Kaepernick would still have been victimized by collusion."

This thing was always going to settle out of court. I'm not sure where the shock is coming from. 90% of the time these kind of cases are settled out of court. The only issue is which side has the leverage to dictate the settlement price.

Kaep didnt have a slam dunk, so i doubt get got anywhere close to $80 Mill. But Kaep didnt have to prove an existence of a "cartel" to show collusion - all he had to show was that that some owners had agreed or coordinated not to hire him. The mere prospect of going through discovery and forcing a bunch of NFL owners to testify under oath was probably enough leverage to motivate the NFL to find a way to settle.

But correlation does not equal causation. True, star rankings in the aggregate are correlated with success in the aggregate, but that doesn't mean the ranking services themselves are uniquely predictive. 

As this example shows, the ranking sites mostly reflect the consensus opinion of a particular recruit. You can make up a new ranking system ranks players based on the number and quality of offers and adds an arbitrary number of points for invitations to elite camps and you'd probably have a model that works just about as well in terms of predicting future success.

I love Tru, and he has played well above his ranking, but I just don't see the size or speed of a feature back in the B1G. Turner or Charbonnet could break out, but those are HUGE question marks.

Michigan's tailbacks (Higdon, Evans, Wilson, Turner, Samuels) rushed for over 2100 yards combined last year. Even if Tru and Turner do combine to replicate Higdon's yardage (~1100) that leaves Charbonnet to make up the remaining 1000 yards. That's pretty damn optimistic, even if you believe Charbonnet is a sure thing.

Can Turner or Charbonnet even pass protect? What happens if somebody gets hurt?

And Harbaugh was a .500 coach when he left Stanford for the 49ers. Like Harbaugh, Hoke was a guy who had turned around two bad programs. Ball State was 4-8 when Hoke arrived. Hoke took them to 12-1 his last season before coming to Michigan. Hindsight is 20/20, but at time, Hoke was an ascending coach with a Michigan/Bo pedigree.

I'm not sure where the idea comes from that Martin is some sort of washout because he wasnt All B1G in his redshirt freshman year. Martin played in 11 games, catching passes in 7 games, including games against Notre Dame, Wisconsin and Ohio State. He's not DPJ or Nico or Tarik Black right now, but he seems to be tracking as a guy who could a key piece as an upperclassmen, after guys like DPJ and Nico leave for the NFL (which could well be sooner, rather than later).

Much easier to teach a 6'3" fireball how to catch a football than its to teach a route technician how to run a 4.3. About half of these guys pan out and the other half are busts, but ones that stick end up being first round draft picks.

That's simply an NCAA decision to ban the compensation of athletes - something that wouldn't apply to a scholarship math student or any other student on campus.

That said, I would love to see us bring in an offensive coordinator who can install a modern college offense at Michigan. If that happens, I dont care if Pep stays on as co-offensive passing game coordinator or QB coach or whatever else.

Perhaps, but the defensive coaches have been flat out better at developing the talent that Harbaugh inherited than on the offensive side of the ball. The offensive talent that Harbaugh inherited was not far behind the defensive talent recruiting rankings wise. The big difference is the that defense seems to regularly turn 3 star recruits into drafted NFL players, while the high-ranked offensive recruits that we managed to get seem to frequently end up as busts or transfers.

I think we have to come to terms with the fact that this defense cant really defend teams with any real speed on offense.

The defense actually made a lot of plays today - I bet you will see a lot of good defensive plays on the UFR.  But all of the good was erased by a few big plays given up to blown coverages or a single missed tackle than ended up going for 50+

After the touchdown pass to Tarik Black was overturned, he was on the sideline looking like his whole world had just ended. I can understand being upset with missing an opportunity to make a play, but he really looked awful. I really hope he is okay and there is not anything more going on there.
