I’ll concede the 49ers situation. However, Seattle did offer him a contract and Denver didn’t exactly “low ball” him with $7 million guaranteed, or maybe you make much more than that and it seems low to you.

Also hurting his damages claim is that he walked away from the last year option of his current contract and at least 2 other offers.

Thanks for posting this! As it stands, he may only need to show that 2 teams conspired to not sign him, as you pointed out above.

However, how could anyone prove that there were actual damages suffered as a result of 2 teams agreeing not to sign a player? Let's say that the Patriots and Dolphins agreed they weren't going to sign Kaep. He still has 30 other teams he could play for. How did that agreement hurt him in terms of a dollar value? That's up to his lawyer to figure out.

Two side notes from the SI article:

1. This provision seems almost impossible to enforce; and

2. What is "clear preponderance of the evidence?" I've heard of clear and convincing evidence and preponderance of the evidence, but not a mixture of the two.

Kaep is alleging that all 32 NFL owners agreed to not hire him. DOJ has brought several cases like this in the last couple years, usually involving franchise agreements. He is alleging that agreement restrained his ability to find work and compete in the marketplace (the NFL). 

You're right that he may have been able to show a few owners agreed to not hire him, and that may have entitled him to some money. but his entire case (IMO) rested on the fact that not one owner wanted to hire him, which there is evidence to the contrary. 

The NFL never wanted to litigate this case, but I really doubt that means Kaep will play again. But whatever he got from the settlement is probably enough for him not to care.

Kneeling aside, Kaep is a pretty big asshole. The 49ers offered him an extension, which he refused because he thought he should get more money. I thought someone else (maybe Seattle?) offered him a contract too, but I'm not sure so I'm not holding it against him.

Then, no one in the NFL wants him and the type of media attention he brings, so he sues the NFL alleging collusion. Cartels are inherently unstable, and a cartel of 32 is a ridiculous assertion.  He wins an undisclosed amount of money for his efforts, I doubt it is $60-$80 million though.

He's then offered a contract in the AAF, which is designed specifically for guys like him. He hasn't played a down since 2016, and he thinks he's worth a $20 million contract? Dude is delusional.

Putting the whole kneeling thing aside, are the above actions going to make owners want to line up and sign him? He is/was a borderline starter without Harbaugh as his coach. You add the extra attention and his over-inflated sense of self worth, and I think most teams just didn't want to deal with him.

I'm no NFL defender either. I think Goddell and most of the owners are pretty big assholes too for a lot of reasons, but the Kaep thing isn't one of those reasons.

EDIT: Looks like he opted out of the last year of his contract with the 49ers (who wanted to extend him) and turned down Seattle and Denver. Collusion case blown up.

I don't the NFL overtime rule is that bad. Some people act like offenses are scoring touchdowns without playing a defense. Once the NFL got rid of the field goal rule, I think OT improved greatly.

I would like to see them play for a full 15 mins and whoever has more points wins. If still tied after 15, then the games ends in a tie unless its the playoffs or Super Bowl.

I don't live there so I have no clue what the weather is like, but I've enjoyed this thread. We got 11 inches of snow a couple weeks ago and the whole DMV region shut down. Schools are usually closed or delayed at even the hint of a dusting here. Since I don't have kids, it only means there are fewer cars on the road when I drive in.

Earlier this year, 4 kids got hit by a car that jumped onto the sidewalk at their bus stop, but fortunately they all survived. It was sunny and 60 degrees that day.

I have read a few stories on this, and it is unclear to me whether the kid knew that his options were prep school or find a new place on January 14 or yesterday. Seth's article makes the latter date seem definitive.

It would be nice to know exactly what Harbaugh told APH and APH's family when the offer was initially extended, on the early signing day, January 14th, and yesterday. I agree it's not a good look and Harbaugh will probably get raked for it, but there's a difference between knowing nearly 4 weeks before NSD and 2 days in my opinion.

The real strategy is to mix up runs and high percentage passes on first down to keep the defense guessing. I hate when we run on first down seemingly every time, and I hate when teams take deep shots on first down.  A 4-5 yard pass on first down is a good play.

1. I never advocated for skipping and I don't think UM should skip mainly for the extra practices, just asking if there's a situation when UM would skip;

2. Notre Dame went 6-6 in 2009 and skipped (they fired Charlie Weis), and went 8-3 in 1996 and skipped (Lou Holtz retired); and

3. All B1G schools get money from the conference even if they don't go to a bowl game.  I am about 80% sure they all get the same amount.

This goes against what I usually think for multiple reasons, but there is a lack of parity issue in CFB that makes it more dull.  Everyone knew back in August that Bama and Clemson were going to be in the playoff and the other 2 teams didn't matter.  Sure it would have been nice to be in, but getting pasted by Bama or Clemson wouldn't make me feel any better.

The NFL has 7 new playoff teams this season (HOU, BAL, LAC, IND, CHI, DAL, SEA) and we've seen 6 seeds win playoff games.  That kind of parity makes the game more interesting to a broader set of people. 

I don't what the NCAA can do to have more parity in college football (not that they care) other than actually investigating and enforcing its own rules, but CFB has become "same thing, different year" for a couple seasons now, and I will mark down a Bama/Clemson final for 2020 too.

I am going to preface this with: 1. I am a lawyer; and 2. This isn’t legal advice. 

It seems your mom has a pretty easy negligence case. There may be medical malpractice but I don’t know anything about that area of law. Even if there’s a medically relevant reason for the chair in the treadmill, there’s no reason for the treadmill to be on while your mom is seated in the chair on the treadmill. 

If you decide to talk to a lawyer, many get 30% of recovery as a fee. So if awarded damages are $10,000 your mom gets $7,000. I don’t know what damages would be based on the extent of her injuries. The doctor should at least be paying the medical bills and there would likely be a few grand in pain and suffering. 

There’s a good chance the case would settle before court. Doctors pay a malpractice insurance for a reason. And your lawyer would negotiate that for you. If it does go to court, it could be over a year to actually see damages paid out.

I would make sure you document the injuries by taking pictures and seeing if you can get a copy of the medical chart after she was taken in for the fall. Things with dates closest to the injury will be most helpful.

I agree, which is why I think the CFP "ruining" other bowl games doesn't make sense.  If anything, the CFP added a "meaningful" game for 2 more teams than under the BCS.

I am torn on how I feel about players sitting the bowl game.   My first thought is Jaylen Smith (sure bet first round pick with no injury history) and to a lesser extent Jake Butt (long injury history).  On the other hand, the team, the team, the team.  

I wonder if it would be possible for the university to have an insurance pool for athletes and could pay the injured athlete after he/she leaves.  Obviously there's some actuarial calculation to determine how much compensation an athlete should receive for the injury, but I think fewer players would sit if they knew the university had their backs.

One insurance complication is that many athletes may be more high risk than the average insurance pool, but I'm sure the university could figure out how to make it work.

Can someone explain to me why players didn’t sit out in the old BCS system? After the top 2 teams, the rest of the games were meaningless in the same way non-CFP games are. I think the timing is more coincidental with players sitting as the CFP began, because all non-championship bcs games were as meaningless.

NFL is a different game for some positions though.  Denard is a perfect example of someone who floated Hoke to a respectable overall record but wasn't that highly rated and was never going to be a day one pick.

I think a lot of college skill positions don't translate well to the NFL.  Linebackers too.  I would say the best bets are good o-line/dline guys and DB's.  Running backs in certain systems can be more successful than others in the NFL.
